1. Copyright notices
A copyright owner or authorized agent may submit a notice through the Last public copyright form or by email to [email protected]. A facially complete notice should identify the copyrighted work, identify the Last material claimed to infringe sufficiently for Last to locate it, provide claimant contact information, include the required good-faith/accuracy/authority statements, and include the required signature.
A facially complete notice causes the identified photo to be hidden while the uploader receives notice and a counter-notice opportunity. Takedown receipt alone is not a punitive finding.
2. Uploader counter-notice
The uploader has 14 calendar days from Last's takedown notice to submit a counter-notice through Last's product process. This filing period is distinct from the later statutory restoration period.
A counter-notice must include:
- the uploader's physical or electronic signature;
- identification of the material that was removed or disabled and the location where it appeared before removal;
- a statement under penalty of perjury that the uploader has a good-faith belief the material was removed or disabled because of mistake or misidentification;
- the uploader's name, address, and telephone number;
- consent to the jurisdiction of the appropriate federal district court; and
- consent to accept service of process from the claimant or the claimant's agent.
Last informs the uploader that the required name and address will be forwarded to the claimant. Last forwards a valid counter-notice to the claimant, and receipt of the valid counter-notice begins the separate 10-14 business-day restoration period.
3. Restoration / filed action
If, during the statutory restoration period, the claimant provides notice that an action seeking a court order has been filed, Last records the court/case information and keeps the photo unavailable under the applicable process.
If no qualifying filed-action notice arrives by the applicable restoration deadline, Last restores the photo, issues no Last copyright infraction for that claim, and removes the corresponding Last DMCA hash block.
4. Repeat-infringer / product-policy consequence
If the uploader submits no valid counter-notice within the 14-calendar-day product window, the claim becomes a Last copyright infraction under the adopted repeat-infringer policy. A qualifying filed-action notice after a valid counter-notice likewise establishes the Last copyright infraction under the applicable process.
Confirmed copyright infractions count under Track 1 of the moderation rules in the Terms of Use; there is no separate copyright penalty ladder. A human reviewer may correct/reverse an infraction determination where the applicable evidence supports it.
5. Hash block and replacement photo
A removed image may be added to Last's exact internal removed-content blocklist. A successful counter-notice/no-suit restoration removes the applicable DMCA blocklist entry. A removed required profile photo follows the ordinary replacement/retake flow while unavailable.
